Terms of Service for Hatorki

1. Acceptance of Terms

Welcome to Hatorki ("we," "our," or "us"). By registering for an account, accessing, or using the Hatorki web application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Hatorki is a social media management tool that allows users to draft, schedule, and publish content to various supported third-party social media platforms.

Content Ownership: You retain full intellectual property rights and ownership of all content you create, upload, or publish through Hatorki. By using the Service, you grant Hatorki only a limited, non-exclusive, revocable, temporary license to store, process, and transmit your content solely for the purpose of scheduling and publishing it to your connected social media accounts on your behalf. This license terminates immediately when the content is published, deleted, or when you close your account. We do not claim any ownership over your content, nor do we use it for any purpose other than providing the Service.

3. Subscriptions, Trials, and No Refunds

• Free Trials: We may offer a free trial period for you to evaluate the Service. During this trial period, access to the features is completely free of charge.
• Billing: At the end of a free trial, or upon selecting a paid plan, you will be billed on a recurring basis via our secure payment partners (e.g., Stripe, Razorpay).
• Strict No-Refund Policy: All payments made to Hatorki are final. We do not offer refunds, prorated refunds, or credits for any underlying subscription, including partial months of service. You may cancel your subscription at any time to prevent future charges, and your access will remain active until the end of your current billing cycle.

4. Acceptable Use and Spam Policy

You agree to use Hatorki responsibly and in compliance with the rules of the platforms you are posting to.

• Prohibited Conduct: You may not use the Service to distribute spam, malicious content, or content that violates the community guidelines of connected networks.
• Actionable Offenses: While we do not employ immediate, automated bans for minor infractions, violations of this acceptable use policy are actionable. Hatorki reserves the right to issue warnings, temporarily suspend posting capabilities, or terminate accounts if your actions threaten the integrity of our Service or risk penalizing our API access with third-party networks.

5. Third-Party Services and Platform Rules

Hatorki relies on the APIs of third-party platforms (including but not limited to YouTube, Instagram, Facebook, Threads, X/Twitter, LinkedIn, Pinterest, TikTok, and Bluesky).

• By using Hatorki to post to these platforms, you explicitly agree to comply with their respective Terms of Service.
• Specifically for YouTube: By connecting your YouTube account, you agree to be bound by the YouTube Terms of Service.

6. Disclaimer of Warranties ("As-Is" Service)

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Because Hatorki interacts heavily with third-party social media APIs, we cannot guarantee uninterrupted service. If a third-party platform changes its API, goes offline, or restricts our access, certain features of Hatorki may break or become temporarily unavailable. We disclaim all warranties, express or implied, regarding the reliability, accuracy, or continuous availability of the Service.

7. Beta Services Disclaimer

From time to time, we may offer access to features or services classified as "Beta" or "Early Access." These services are provided entirely "as is" and "as available" for testing and evaluation purposes. We do not guarantee that Beta services will be free of errors, bugs, or interruptions. By using our Beta services, you acknowledge that scheduled posts may fail, data may be temporarily unavailable, and Hatorki holds no liability for any loss of content, revenue, or business disruption resulting from the use of our Beta platform.

8. Limitation of Liability

To the maximum extent permitted by law, Hatorki and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, loss of data, loss of social media engagement, or the suspension/banning of your third-party social media accounts resulting from your use of the Service.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes or claims arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Assam, India.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Effective Date" and/or providing notice within the application. Continued use of the Service after changes constitute your acceptance of the new Terms.
